Ghosh, Sr. Adv.<br \/>\n                              Mr. Debabrta Banerjee, Adv.<br \/>\nR2                            Mr. Ashok Mathur, Adv.<br \/>\n\fIA 20 IN SLP(C)15814\/11<br \/>\n                                                      2<\/p>\n<p>                    UPON hearing counsel the Court made the following<br \/>\n                                        O R D E R<\/p>\n<p>                           I.A.20 of 2011, has been filed on behalf of<\/p>\n<p>                 the      respondents,    inter        alia,       for    vacating       the<\/p>\n<p>                 interim orders passed by this Court on 6th June,<\/p>\n<p>                 2011 and 5th July, 2011.<\/p>\n<p>                 2.        The dispute is between two societies having<\/p>\n<p>                 identical names and claiming to be the owners and<\/p>\n<p>                 in management of the temple of the International<\/p>\n<p>                 Society for Krishna Consciousness, Bangalore.<\/p>\n<p>                 3.        By   the    order    dated       6th    June,        2011,   this<\/p>\n<p>                 Court      while     issuing    notice           and    after     hearing<\/p>\n<p>                 learned counsel for both the parties, gave certain<\/p>\n<p>                 interim directions and one of the directions we are<\/p>\n<p>                 concerned with reads as follows:-<\/p>\n<p>                                                      &#8220;&#8230;..5.           In       the<br \/>\n                                meanwhile,,           the    parties            shall<br \/>\n                                maintain status quo, as of today.<br \/>\n                                However,        the       Bangalore        Society<br \/>\n                                with its present officer bearers<br \/>\n                                shall           continue                day-to-day<br \/>\n                                management       of       the      Society        but<br \/>\n                                would     not     take      any         major     and<br \/>\n                                policy           decision                 creating<br \/>\n                                liabilities       of any          kind for        the<br \/>\n                                Bangalore Society.&#8221;<br \/>\n\fIA 20 IN SLP(C)15814\/11<br \/>\n                                                       3<\/p>\n<p>                 4.          The    present        I.A.20    has   been    filed    for<\/p>\n<p>                 vacation of the said directions.<\/p>\n<p>                 5.          By    virtue     of     the    aforesaid     order,    the<\/p>\n<p>                 petitioner-society has been running the affairs of<\/p>\n<p>                 the temple at Bangalore till date.                  However, since<\/p>\n<p>                 a        decree    has     been    passed    in   favour    of     the<\/p>\n<p>                 respondent-society,           wherein       directions    have    been<\/p>\n<p>                 given to the petitioners not to interfere with the<\/p>\n<p>                 possession of the respondent society in the temple<\/p>\n<p>                 and its properties,               we are of the view that some<\/p>\n<p>                 arrangement has to be made till we can hear out the<\/p>\n<p>                 Special Leave Petition, for the temple at Bangalore<\/p>\n<p>                 to be managed in a manner so that there is some<\/p>\n<p>                 amount of transparency.<\/p>\n<p>                 6.          Having heard Mr. Venugopal, learned senior<\/p>\n<p>                 counsel for the applicant in I.A.20, and Mr. Lalit,<\/p>\n<p>                 learned           senior     counsel        appearing      for     the<\/p>\n<p>                 petitioner-society in the Special Leave Petition,<\/p>\n<p>                 we direct that the Special Leave Petition, which we<\/p>\n<p>                 are informed is otherwise ready for hearing, be<\/p>\n<p>                 listed for final hearing on 15th February, 2012, at<\/p>\n<p>                 the top of the list.<\/p>\n<p>                 7.          In the meantime, in addition to the interim<\/p>\n<p>                 directions, which had been given in the order of<\/p>\n<p>                 6th June, 2011, we appoint a Committee to oversee<\/p>\n<p>                 the management of the temple and its properties.<br \/>\n\fIA 20 IN SLP(C)15814\/11<br \/>\n                                                 4<\/p>\n<p>                 The said Committee shall consist of:-<\/p>\n<p>                      1. Hon&#8217;ble Mr. Justice R.V. Raveendaran(retd.) as<\/p>\n<p>                          Chairman.<\/p>\n<p>                      2. Shri Ananda Thirtha Das, Member.<\/p>\n<p>                      3. Shri Stoka Krishna Das, Member.<\/p>\n<p>                 The said Committee shall oversee the management of<\/p>\n<p>                 the temple and its properties by the petitioner-<\/p>\n<p>                 society and shall be entitled to advise the said<\/p>\n<p>                 society on matters relating to the management of<\/p>\n<p>                 the temple and its properties.<\/p>\n<p>                 8.         The Chairman shall be paid a remuneration of<\/p>\n<p>                 ` One Lakh per month from the temple funds.<\/p>\n<p>                 9.         This   order   is   without   prejudice   to   the<\/p>\n<p>                 rights and contentions of the parties at the time<\/p>\n<p>                 of hearing of the Special Leave Petition.<\/p>\n<p>                 10.        The Committee will be at liberty to apply to<\/p>\n<p>                 this Court in the event it becomes necessary to do<\/p>\n<p>                 so.<\/p>\n<p>                 11.
